Mr. Salauddin Kader has the courage to face any challenge and the determination to accomplish any task at hand regardless of the difficulty it may present. He has a deep understanding of international taxation laws, customs rules and regulations and has helped the Chambers with several tax, customs and related tribunals matters since his joining. He works from our Headquarters.

He is a member of  International Department. The department’s international work is recognised under Corporate & Finance by Chambers and Partners 2023 Global Guide. The editorial says: “They are professional, and their team is well organised to assist us with complex and sophisticated matters.”

He is also member of our Taxes and Finance Department, which is ranked under Corporate & Finance by Chambers and Partners 2023 Asia Pacific Guide.  The editorial of dispute resolution says: “Rahman’s Chambers defended Larsen & Toubro against a tax penalty amounting approximately to USD1 million, imposed due to Larsen’s delay in filing its tax returns”.

Mr. Kader completed his LL.B from American International University – Bangladesh (AIUB) and subsequently earned his LL.M. from North South University, Bangladesh.He joined the Chambers in 2023 as a Junior Associate. After demonstrating significant skill and dedication, he was promoted to the position of Associate.

As a member of the ADR, Land, and Tribunals team, his practice involves drafting submissions, filing applications, and conducting hearings in matters related to Customs, VAT, and Tax. He handles cases before various tribunals for notable clients, including Philips and OFMA. The department where Mr. Kader is a member has a long-standing and prestigious ranking by Chambers and Partners.

Taxes and Finance 

As part of the Firm’s Taxes and Finance Department, he was involved in the following works:

Taxation

  • Assisted our client by providing 56 HSN codes along with the TTI for the spare parts which is intended to import by our client from a renowned Manufacture of machinery and equipment company.
  • We have acted on behalf of our client by filing an Income Tax Reference on behalf of our client against the order passed by the Taxes Appellate Tribunal upholding a maximum penalty of BDT. 52,67,725/-
  • Assisted our client by providing the HSN Code along with the duty rate for the product named water chiller along with the exception available for the product
  • Assisted our client by providing the 76 HSN Codes along with the duty rate for the spare parts which the client intends to import  from a renowned Manufacture of machinery and equipment company.
  • Assisted our client by providing the HSN code of Thermal Oil Heater and 21 HSN Code along eith the duty rate for the spare parts of the Thermal oil Heater along with the exemption available for the part.
  • We have given the answer of their specific queries regarding Cold Storages Services from the third party vendor, applicable VAT upon purchase chemical for cold storage and the available exemption.
  • We provided a legal opinion to our client regarding Industrial IRC, Commercial IRC, BIDA permission, BIDA guideline of 2023.
  • We have submitted supplementary grounds appeal before the Taxes Appellate Tribunal on behalf of our client. But the tribunal didn’t apply his mind and dismissed the appeal.
  • We have assisted our client by providing the HSN Code along with the duty rate for the Fire Suppression System and the available exemption for the product and also the process to obtain permission from Department of Explosion.
  • We have assisted our client by providing a legal opinion in respect of the unauthorized payment of 2,66,50000 taka to Category ‘G’ (Independent Director) of the Board.
  • Worked on several appeal pending for a Dutch multinational corporation that leads the global lighting industryon Valuation and HS Codes in Bangladesh.
  • Worked on various formation of a gratuity deposit fund trust and also assisted in the process of registering the trust with the National Board of Revenue to facilitate the process of claiming tax exemptions applicable for gratuity payment.
  • Worked on due diligence for a global animal nutrition company, on several customs duties and exemptions.

International 

As part of the Firm’s International Department, he was involved in the following works:

  • Assisted the Department on behalf of a feeder shipping services company in an arbitration before the London Maritime Arbitrators Association (LMAA). A Statement of Claim was submitted with several supporting bundles covering basic documents, war risk issues, incidental losses, storage claims, and the arrest of one vessel in India and another in Karachi.
  • Involved in advising a major MNC involving double taxation treaty benefits with its operation of branch office and several projects.
  • Involved in advising an MNC having significant investment in Bangladesh on international law involving compliance of labor, environmental treaties, changes involving the new EU GSP scheme, WTO’s SCM Agreements, and signing of PTAs, FTA,s and CEPA in relation to LDC graduation of Bangladesh in 2026.

Organisation Plan 

A associate lawyer is an experienced member of a Team, senior to/promoted from the post of Junior Associates. They assist the Chambers with legal research, fact analysis,  coordinating with clients and often on procedural issues. They also prepares legal opinion, draft pleading and finalise the same under the supervision of  the senior colleagues.
