HYBRID SEMINAR ON INDUSTRIAL DESIGN ACT 2023
The landscape of Intellectual Property (IP) rights and laws in Bangladesh has undergone significant reforms over the past few years. For over a century, the cornerstone of IP law and rights was enshrined within the Patents and Designs Act, 1911; an inherited legislation and a relic of the British colonial era, which governed both patents and designs under a single framework. While it offered a legal basis for protecting the aesthetic aspects of manufactured articles, it was largely a product of its time and often fell short of contemporary international standards.
Following its independence in 1971, Bangladesh began the gradual process of aligning its IP laws with international norm as a member of the World Intellectual Property Organization (WIPO) in 1985, ratification of the Paris Convention for the Protection of Industrial Property in 1991, the Berne Convention for the Protection of Literary and Artistic Works in 1999 and also as a signatory to TRIPS of WTO.
Industrial design as IP disputes often involve large corporations fiercely protecting their brand identity and aesthetic innovation, unlike trademark, copyright or patent infringement, the primary purpose is to protect the intellectual property rights associated with the aesthetic and visual aspects of the products having industrial application. Notable international lawsuits namely the “Smartphone Wars” (between Samsung and Apple) or Adidas and Sketcher (shoe brands) are testamentary to MNCs’ reliance on protection of their IP rights.
From Bangladesh’s perspective, the culture of vigorous enforcement and high-profile litigation, especially for industrial designs, is still maturing compared to more developed economies with more attention in Bangladesh’s IP landscape been given to trademark and copyright infringement. With high value emerging sectors such as Apparel and Textiles, Consumer Goods, and Packaging are a few areas where design protection is sought and disputes arise. The protection of industrial designs is essential for fostering innovation, encouraging investment, and enabling Bangladeshi products to compete effectively in both domestic and international markets.
We will discuss and analyze the current legal issues involving the Industrial Design Act 2023, etc. The seminar will be conducted in a hybrid fashion, where participants can join physically or virtually. Please note we have limited space for physical participation.
