WEBINAR ON FUNDAMENTAL RIGHTS, JUDICIAL REVIEW & WRITS IN BANGLADESH

Procedural violations or administrative actions taken without following due procedure, arbitrarily, unreasonably, or in violation of fundamental rights, etc, can be expeditiously resolved by judicially reviewing the same, popularly known as a filing writ petition, before the Hon’ble High Court, where there is no other efficacious alternative forum available. 

In 2023, the High Court Division, by a judgment and order dated 11.01.2023 allowed a writ petition and directed the respondents to consider the promotion of the petitioner to the post of Chief Engineer, RAJUK with retrospective effect from the date of his eligibility as he has fulfilled the requisite qualifications prescribed in the Rajdhani Unnayan Kattripokko (Officers and Employees) Service Rules, 2013. The Hon’ble Court held that to be considered for promotion is a vested right depending on the requisition qualifications under Article 29 of the Constitution of Bangladesh as it guarantees equality of opportunity in public employment for all citizens of Bangladesh even if there is no discrimination at the date of initial appointment of the petitioner.

Similarly, in Banu vs. Bangladesh and Ors. (31.12.2020 – BDHC): LEX/BDHC/0031/2020, hon’ble High Court bench comprising Mr. Justice Md. Mozibur Rahman Miah and Mr. Justice Mohi Uddin Shamim, JJ. held that detenue is entitled to have compensation at Taka 20,00,000/- (Taka Twenty lakh only) for his wrongful confinement. There has been no standard policy to measure the amount of compensation, however, the Hon’ble court fixed the amount keeping in mind the surrounding circumstances particularly based on earnings per week. Applying the principles of vicarious liability, the Hon’ble Court also held that compensation for the detenue to be borne by the highest authority of the police force because subordinate police officials were found responsible for the wrong confinement of the detenueIt is now becoming increasingly possible to get compensation for the negligent liability of an authority from the honorable High Court.
