For Sovereign Leaders & State Entities: Managing Arbitration Risks The EPA introduces platinum-tier protections for foreign investors, granting them the right to bypass local courts through Investor-State Dispute Settlement (ISDS) mechanisms (such as ICSID or UNCITRAL). We will explore how the state can navigate strict prohibitions on “Performance Requirements” without triggering costly international litigation over treaty breaches or “indirect expropriation.”

For Regulatory Bodies & State Agencies: Harmonizing Domestic Law The treaty presents institutional risks that mandate an urgent audit of domestic legislation. We will discuss why state cyber and telecom regulators must harmonize local frameworks—such as the Cyber Security Act—to avoid conflicts with the EPA’s strict bans on “Data Localization” and forced access to software source codes.
